The terms and conditions stipulated below will apply to the services offered by LUMA Law. This is the main agreement between you and LUMA Law as far as the services are concerned, so please read it carefully before making payment. By placing an order for any of our services or by accepting any quote, you confirm that you agree with and are bound by these terms of engagement.
1. Definitions
a. LUMA Law refers to LUMA Law (Pty) Ltd, a private company conducting business as an alternative, non-litigious legal service provider. Also, the product owner and all payments are made to Luma Law.
b. LAW FOR ALL refers to LIPCO Group (Pty) Ltd, a private company conducting business as legal services administrator, contracted by LUMA Law to render advice and mediation services to LUMA Law clients.
c. Client refers to you, the natural person who signed up for the service.
d. Service/s refers to the service/s you specified in your order and will be interpreted as follows:
i. Consultation & Advice Service: Telephonic legal advice and guidance on civil, criminal, labour and family matters relating to a private legal issue/dispute where you need to enforce your rights in your personal capacity (i.e., not on behalf of any business entity or a third party).
ii. Third-Party Mediation Service: Telephonic legal advice, guidance, and assistance to resolve personal legal disputes through informal mediation, negotiation, and alternative dispute resolution processes. It includes correspondence (telephonic as well as via emails and letters) between our advisors and third parties to resolve civil, family, and labour disputes effectively without having to litigate (i.e,. go to court). This Service will also include:
– drafting of a settlement agreement where settlement was reached between you and the third party;
– litigation referrals, which entails a referral to one of LAW FOR ALL’s panel attorneys at your own cost, but at reduced pre-arranged rates where a matter becomes litigious or can’t be resolved by way of negotiation/mediation;
iii. Additional Services:
– Drafting a parenting plan under the Children’s Act;
– Drafting of a will;
– Drafting of basic contracts (excludes formal registration and notarisation);
– Any other Additional Services offered by LUMA Law.
2. Limitations & Exclusions
The following limitations and exclusions will apply to our services:
a. Services are rendered from Mondays to Fridays from 8h00 – 16h30, excluding public holidays;
b. You are only allowed to make use of our approved advisors and mediators;
c. Services will only be available to natural persons in their personal capacity and will exclude any business-related entities or assistance with business-related transactions where the Client acts on behalf of such business;
d. None of the services will include personal (face-to-face) consultations, litigation, or court representation and will be limited to correspondence via telephone, email, letters, and other forms of electronic communication such as Microsoft Teams and Zoom;
e. Mediation will exclude formal mediation as per statutory court rules;
f. Any service not specifically mentioned under the service you opted for will be excluded;
g. Services are only to be rendered within the borders of South Africa;
h. All services rendered are based on professional judgment and are not any guarantee of an outcome. Such advice, even when described as an opinion, is necessarily limited by our knowledge of the facts and is based on our views of the state of the law at the time. In engaging us, you recognise that all legal matters involve risks. We cannot and have not made any promises or guarantees to you about the outcome of the representation, and nothing herein shall be construed as such a promise or guarantee.
3. Your Obligations
a. Don’t delay – when you become aware of a legal issue for which you need our help, make sure that you book a consultation by following the steps on our website.
b. We cannot help you if we don’t have enough insight into your case. It’s your responsibility to pay for and provide us with all the necessary documents, reports, statements, and other evidence that we might need. If you don’t send us these documents, we may be unable to assist you.
Kindly Note: Failure to provide us with the documents or info we need to assist will not entitle you to a refund.
c. Whenever you send us information, triple-check that it’s 100% correct, and don’t keep any crucial, relevant, information from us. If you are not honest with us, it will prejudice your case, and we might not be able to assist you properly.
d. Always make timeous payments to avoid delays.
4. Payment
a. Fees for our services will be charged at the rates stipulated on the LUMA website and is subject to change;
b. All quoted fees must be paid before services are rendered;
c. Although initial consultations are charged at a fixed rate, we will quote you on the services you require, based on the info provided to us during the initial consultation;
d. Should you accept our quotation, LUMA Law may, in its sole discretion, deduct any amount already paid for consultations from the service quotation;
e. LUMA Law will provide you with a quotation for services and wait for your acceptance and payment before acting on any instruction;
f. Fee and disbursement estimates are for guidance purposes only and will be based on the information provided by you. These estimates may be subject to change due to unforeseen complexity and time spent, but you will be duly notified thereof before we proceed;
5. Privacy Notice
a. Please note that we collect and process your personal information to enable us to provide you with our products and services. We may share it with LAW FOR ALL, its service providers and other third parties to comply with our obligations.
b. All the personal information we share is subject to our privacy and security requirements, and we are responsible for ensuring that your personal information is processed lawfully and in a reasonable manner that does not infringe your privacy rights.
c. We may make automated decisions based on your personal information, and should you be unhappy with the outcome, please feel free to contact us.
d. We will notify you if we intend to use your personal data for other purposes.
e. We will keep your personal information only for as long as the law requires us to. After this time, we will securely destroy or de-identify this information.
f. You have the right to ask us for access to your personal information and to instruct us to amend and delete any personal information or to object to us processing your personal information. You can also let us know if you want us to stop or limit our use of your personal information.
